Terms of Service (Legal Disclaimers)

These Terms of Service (“Terms”) govern your use of the PlanWorks Australia website (planworksaustralia.com) and the services provided by PlanWorks Australia (ABN 43 658 538 982). By requesting a quote, engaging our services, or using this website, you agree to these Terms.

1. Our Services

PlanWorks Australia prepares site plans, elevation drawings, and supporting documentation (including our DIY Council Approval Guide) to assist property owners in Western Australia with council building and planning approval applications for patios, pergolas, carports, sheds, retaining walls, and retrospective/unauthorised structures.

We do not lodge applications on your behalf, act as your building surveyor, or provide structural engineering services. Where engineering or building surveyor input is required, we may refer you to trusted third parties — engagement with those parties is a separate arrangement between you and them.

2. Accuracy of Information You Provide

Our drawings are prepared based on the project details, measurements, and site information (including satellite/aerial mapping data) you provide or that we source using the location you share. You are responsible for checking that this information — including boundaries, dimensions, and site conditions — is accurate. We are not liable for errors arising from incorrect or incomplete information supplied by you.

3. Council Approval Is Not Guaranteed

While our drawings are prepared to align with common WA planning and building requirements, final approval decisions rest solely with the relevant local council or building surveyor. We do not guarantee that any application will be approved, and council requirements can vary by location and change over time.

4. Payment and Delivery

Pricing is as set out on our Pricing page at the time of your order, unless otherwise agreed in writing. Drawings are typically delivered within 4 business days of receiving all required project information. Delays in providing information may extend this timeframe.

5. Revisions and Refunds

One revision is included per drawing paid for. Additional revisions beyond this may incur a further fee, which we will confirm with you before proceeding.

6. Intellectual Property

Drawings, guides, and materials we produce remain our intellectual property until full payment is received. Once paid, you may use the drawings for the purpose of your council application. You may not resell or redistribute our DIY Council Approval Guide.

7. Limitation of Liability

To the maximum extent permitted by law, PlanWorks Australia’s liability for any claim arising from our services is limited to the amount paid for that service. We are not liable for indirect or consequential loss, including delays, council rejections, or costs arising from construction undertaken based on our drawings.

8. Governing Law

These Terms are governed by the laws of Western Australia.
